Course purpose
This Specialist course develops the legal literacy required to support corruption and bribery investigations without turning the forensic accountant into the legal decision-maker. It compares international instruments and selected national approaches to offence elements, jurisdiction, public officials, associated persons, corporate liability, books and records, gifts, hospitality, facilitation payments, defenses, reporting, sanctions and international cooperation. Learners translate legal questions into testable evidence propositions, preserve procedural fairness and maintain a documented jurisdiction matrix. The course uses UNCAC, OECD instruments, the United States FCPA Resource Guide and United Kingdom Bribery Act guidance as learning references; none is universal law. Current legislation, case law, prosecutorial policy, contract terms and competent legal advice in every relevant jurisdiction remain controlling.
Learning outcomes
By the end of this course, you should be able to:
1. Map applicable anti-corruption sources, offence elements, jurisdictional connections and authorized decision-makers for a cross-border matter.
2. Distinguish individual, intermediary and organizational exposure, including books-and-records and failure-to-prevent concepts, under the relevant framework.
3. Design evidence procedures that address legal criteria, privilege, privacy, interviews, cooperation and due process without prejudging liability.
Frame reporting, sanctions, remediation and prevention options for authorized legal and governance decisions with limitations clearly stated.
